During the 2008 legislative session, the legislature appropriated funds to pay for an independent review of the PSC’s rules and practices, including recommendations for any changes and assistance in implementing such changes. On February 4, 2009, the PSC awarded the consulting contract for the review and recommendations to the law firm of Hinshaw & Culbertson LLP. On March 3, 2009, the PSC opened a working docket to allow parties to review and comment on the materials prepared by the consultant.
On April 29, 2009, the Commission held an initial pre-drafting meeting for interested parties to introduce the consultant and receive comments on the record. Written comments were also filed. On June 3, 2009, the consultant filed “the first of at least two proposals” to govern ex parte communications with the PSC. The consultant’s proposed time frame calls for a recommended rule to be sent for publication in the Missouri Register on July 10, 2009, and a revised and finalized recommendation presented to the PSC by August 7, 2009.
