OPC Petitions to Expand/Modify MCA Plan

On November 22, 2004, the Office of Public Counsel (OPC) filed separate motions requesting that the Commission modify the Kansas City and Springfield MCA plans and expand the geographic boundaries of the St. Louis MCA plan. Specifically, Public Counsel's Kansas City MCA requests sought to reclassify the Greenwood exchange from MCA-3 to MCA-2,. In the Springfield MCA, Public Counsel proposed to reclassify the Ozark exchange from MCA-2 to MCA-1. Finally, Public Counsel proposed to expand the St. Louis MCA to include the exchanges of Washington, Union, Wright City, St. Clair, Marthasville, Beaufort, Foley, and Warrenton. Case numbers and case status are as follows:

A.TO-2005-0141 (St. Louis MCA expansion)

On February 23, 2006, the Commission issued an Order Approving the Stipulation and Agreement between AT&T, OPC, and Staff and directing AT&T to file tariffs in compliance with the agreement. Accordingly, on June 29, 2006, AT&T filed revised tariff sheets to add the exchanges of Beaufort, St. Clair, Union, and Washington to "Tier 5" of the St. Louis MCA beginning October 30, 2006. The tariff sheets have an October 30, 2006 effective date.

On May 18, 2006, the Commission issued an Order Approving the Stipulation and Agreement between CenturyTel, OPC, and Staff and directing CenturyTel to file tariffs in compliance with the agreement. Accordingly, on June 19, 2006, CenturyTel filed revised tariff sheets to establish a new "Tier 6" of the St. Louis MCA in the CenturyTel exchanges of Foley, Holstein, Marthasville, Warrenton, and Wright City. The tariff sheets have a March 1, 2007 effective date.
B.TO-2005-0143 (Springfield MCA)

On January 17, 2006, OPC filed its final recommendation, in which it recommended the following: (1) The Ozark exchange be made a Tier 1 mandatory exchange; (2) The price for MCA service in the Ozark exchange be the same as other Tier 1 exchanges ($12.50 residential and $36.95 business, including local service); and (3) Intercompany compensation be bill-and-keep, the same compensation as other Tier 1 exchanges. Public Counsel requested that the Commission direct the carriers to submit statements of revenue and expense impacts, as well as revenue-neutrality requirements, related to the proposal.

On January 30, 2006, AT&T Missouri and CenturyTel separately filed responses opposing OPC’s final recommendation and moving to have OPC's request for expansion of the MCA Plan dismissed.

On April 11, 2006, the Commission denied the motions to dismiss and directed AT&T and CenturyTel to submit statements of revenue and expense impacts, as well as revenue-neutrality requirements, related to OPC’s proposal. The Commission also directed the parties to file a proposed procedural schedule.

On May 10, 2006, AT&T, CenturyTel, and OPC filed a joint motion to extend the filing dates for the proposed procedural schedule and revenue/expense impacts. The Commission extended the date for a proposed procedural schedule to July 10, 2006 and the revenue/expense impacts to August 8, 2006.

On July 10, OPC filed a request for an extension to file the proposed procedural schedule to August 14, 2006 and to extend the date for AT&T Missouri and CenturyTel to submit their statements of revenue and expense impacts related to Public Counsel’s final recommendation to September 14, 2006
C.TO-2005-0144 (Kansas City MCA – Greenwood exchange)

On January 10 2006, the Commission issued an Order Approving the Stipulation and Agreement between AT&T, OPC, and Staff in which AT&T's Greenwood exchange would become a mandatory MCA exchange in the Kansas City MCA. On April 28, 2006, AT&T filed tariff sheets with a June 29, 2005 effective date. On June 7, 2006 the Commission issued an order approving the tariff sheets and closing the case.
